Terms of Service

These Terms of Service (“Terms”) govern your access to and use of GuestLens (the “Service”), a guest-experience intelligence platform operated by Experience Hospitality (“Experience Hospitality,” “we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms. If you are entering into these Terms on behalf of a restaurant or other organization, you represent that you are authorized to bind that organization.
1. The Service
GuestLens aggregates publicly available guest reviews and ratings (for example from Google, Yelp, OpenTable, and TripAdvisor), combines them with data you provide (such as point-of-sale exports), and produces scorecards, trends, benchmarks, and AI-generated summaries and suggested replies. GuestLens provides information and recommendations to help you run your business; it does not guarantee any particular business outcome.
2. Accounts
You must provide accurate information when registering and keep it up to date. You are responsible for safeguarding your login credentials and for all activity under your account. Notify us promptly at info@experience-hospitality.com if you suspect unauthorized use.
3. Subscriptions & billing
Paid plans are billed in advance on a recurring basis (for example monthly) through our payment processor, Stripe. By subscribing, you authorize us and Stripe to charge your payment method on each renewal until you cancel. Fees are stated at the point of purchase. Unless required by law, fees already paid are non-refundable. You may cancel at any time, and cancellation takes effect at the end of the current billing period. We may change our prices with reasonable advance notice; changes apply to the next billing period.
4. Your data and content
You retain ownership of the data and content you upload (such as POS exports and account details). You grant us a limited license to host, process, and use that data to operate and improve the Service and to provide it back to you. You are responsible for ensuring you have the right to upload any data you provide and that doing so does not violate any law or third-party agreement.
5. Third-party sources and services
The Service relies on third-party platforms and APIs (including Google, Yelp, OpenTable, TripAdvisor, Anthropic, Supabase, Vercel, and Stripe). Your use of data originating from those platforms may be subject to their own terms and licensing requirements, and their availability and accuracy are outside our control. You are responsible for ensuring your use of any third-party data through the Service complies with that provider’s terms, including any commercial-use or licensing requirements that apply to your business.
6. Acceptable use
You agree not to misuse the Service, including by: attempting to access data belonging to other customers; reverse-engineering or scraping the Service; reselling or sublicensing the Service without our written permission; uploading unlawful, infringing, or malicious content; or using the Service to send spam or to violate any platform’s terms (for example, posting review replies that violate a review platform’s policies).
7. AI-generated output
Some features generate text and recommendations using artificial intelligence. AI output may contain errors and should be reviewed by a human before you rely on it or publish it. You are solely responsible for any content you choose to publish, including replies to reviews.
8. Availability
We aim to keep the Service available and reliable but do not guarantee uninterrupted access. We may modify, suspend, or discontinue features from time to time. Planned and unplanned downtime may occur.
9. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free or that any analysis, benchmark, or recommendation is accurate or complete.
10. Limitation of liability
To the maximum extent permitted by law, Experience Hospitality will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues. Our total liability arising out of or relating to the Service will not exceed the amount you paid us for the Service in the twelve months preceding the event giving rise to the claim.
11. Termination
You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your access if you breach these Terms or if we are required to do so by law or by a third-party provider. Upon termination, your right to use the Service ends; certain provisions (such as payment obligations, disclaimers, and limitations of liability) survive.
12. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will provide reasonable notice (for example by email or within the Service). Your continued use after the changes take effect constitutes acceptance of the updated Terms.
